CBI vs CBI: SC orders CVC inquiry into allegations against Alok Verma

He told the Supreme Court that "the details of many cases which have led to the present circumstances are extremely sensitive" and demanded that the agency be insulated from government's interference.

The hearing commenced with Senior Advocate Fali S. Nariman drawing the attention of the bench to the Vineet Narain dictum of the apex court, on insulating the CBI against the government, which was transformed into a Law by virtue of the CVC Act of 2003 and amendments to the Delhi Special Police Establishment Act of 1946. Removing the CBI director will not help.

After hearing several petitions, Supreme Court gave a sensational order and instructed temporary CBI director Mannem Nageswara Rao not to make any decisions till further orders.

The Supreme Court on Friday said the CVC inquiry on allegations of bribery against CBI Director Alok Verma should be completed in two weeks under supervision of court.

He said that recent developments "have eroded the credibility of the Central Bureau of Investigation" and that the "CVC, in the interest of fairness, had passed an order that till investigation or inquiry is pending against the two top officers of the CBI, they must step aside and recuse themselves from the CBI's function". The Congress alleged that it was because Verma had begun asking questions about the Rafale deal that he was removed.

The court also issued notices to the Centre on both petitions. It took a sarcastic take on the allegations of corruption levelled against Verma and Asthana which says "CBI can't C I to I?" Verma had also approved an FIR against Asthana for allegedly taking bribes of around Rs 3 crore and fabricating evidence to "impugn his reputation".

Asthana was also divested of all supervisory charges on Tuesday.

He was part of the two-member Supreme Court bench which had commuted the death sentence of the American Centre attack mastermind Aftab Ansari and Jamulludin Nasir.

It also said that the high-powered committee comprising the Prime Minister, leader of the opposition and Chief Justice of India was not consulted by the Centre before appointing Rao as the interim director.
