Vice President Venkaiah Naidu rejects impeachment motion by CJI

In his 10-page order submitted Monday, Naidu said, "Conversations between third parties... with dubious credentials, which have been extensively relied upon, can not constitute any material evidence against the holder of the office of the Chief Justice of India". However, the Congress has made a decision to challenge the rejection in the Supreme Court of India.

Naidu rejected the Congress-led opposition notice after extensive consultations with top legal and constitutional experts on the maintainability of the motion, sources said.

Shiv Sena leader Arvind Sawant said that the way the impeachment notice was rejected is political and both the Bharatiya Janata Party (BJP) and Congress are playing dirty politics. "In the absence of credible and verifiable information placed before me which gives an indication of "misbehaviour" or "incapacity", it would be an inappropriate and irresponsible act to accept statements which have little empirical basis".

He maintained that the impeachment motion was not meant to insult or lower his dignity but to take the allegation against him to its logical conclusion.

The petition to impeach Chief Justice Dipak Misra for "acts of misbehaviour" and misuse of authority was signed by 64 serving members of the upper house.

In an unusual move, leaders of Opposition parties met Naidu on Friday and handed over the notice of impeachment against the Chief justice of India with supporting signatures of 64 MPs and seven former members, who had retired in the recent past. The Order passed by the Vice President in this regard dismissed the motion on three grounds: no proved misbehaviour, it is an internal matter of the Supreme Court, and that the MPs violated the rule from the handbook.

"A remedy is already available for them (the Congress, which led the efforts to move the motion)", Malhotra said.

Former Secretary General of the Rajya Sabha VK Agnihotri was also consulted. It jeopardizes the judicial system, We will certainly move a petition in the SC to challenge this order.

Sibal said that the decision to reject the motion "shatters the confidence of the people, and destroys the legitimacy of law".
